The Court of Chancery Amends and Adds New Rules Affecting the Magistrate Docket to Address the Incoming Title 16 Cases and Improve Guardianship Procedures

Chancellor Kathaleen St. Jude McCormick today signed an order adopting amendments to Court of Chancery Rules 116, 117, 144, 175, 176, 177, 178, 178-A, 178-B, 180-A, 180-C, and 180-D, and adding new Rules 175-A and 175-B. Title VXII of the Rules has also been retitled “Civil Miscellaneous Matters.” These amendments are effective as of September 30, 2025. The court has also updated its fee schedule to account for the new Title 16 actions.

On September 22, 2025, the Honorable Jessie R. Benavides joined the Court of Chancery as Magistrate in Chancer. Although Magistrate Benavides plans to handle cases throughout the State of Delaware, her chambers will be located in the Kent County Courthouse in Dover, Delaware. Magistrate Benavides occupies one of two newly funded Magistrate in Chancery positions designed to aid the court in its increasing workload.

On September 8, 2025, the Honorable Caroline Brittingham joined the Court of Chancery as Magistrate in Chancery. Although Magistrate Brittingham plans to handle cases throughout the State of Delaware, her chambers will be located in the Court of Chancery Courthouse in Georgetown, Delaware. Magistrate Brittingham occupies one of two newly funded Magistrate in Chancery positions designed to aid the court in its increasing workload.

August 25, 2025—The Delaware Court of Chancery has started using a new procedure to handle routine civil actions to standardize, simplify, and speed the process for both litigants and the court. Under this new procedure, the court has created a new docket called the “Routine Unassigned Action” or “RUA” docket to be taken up by Magistrate Judges on a rotating basis. Matters suitable for the RUA docket include will, trust, estate, and property actions that can be resolved with a single hearing.

Wills


The Register of Wills is responsible for assisting individuals and attorneys with the probate process and maintains records relating to estates. The Register of Wills is a clerk of the Court of Chancery and has an office in each county of the state.
